These Terms of Sale ("Terms of Sale") govern all services and products (collectively, "UZ Marketing Service") offered by UZ Marketing ("UZ Marketing," "we," "us," or "our") including through our websites currently located at www.uzmarketing.com and www.uzmarketing.com and through our "UZ Marketing" mobile application (such websites and mobile applications collectively, this "Site"). In addition, the UZ Marketing Terms of Use and Privacy Policy are hereby incorporated and made a part of these Terms of Sale by this reference. PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING AN ORDER WITH UZ MARKETING. 

Binding Effect

BY PLACING AN ORDER WITH UZ MARKETING, YOU AGREE, WITHOUT LIMITATION OR QUALIFICATION, TO BE BOUND BY THESE TERMS OF SALE, TO WHICH WE RESERVE THE RIGHT TO MAKE CHANGES FROM TIME TO TIME, CONSISTENT WITH APPLICABLE LAW. IF YOU DO NOT AGREE TO THESE TERMS of Sale, DO NOT PLACE AN ORDER WITH UZ MARKETING.

General

Products offered through this Site are offered subject to availability. All products, services, templates, materials, prices, discounts, and promotions posted on this Site are subject to change without notice. You agree to be responsible for all orders placed using your account, username, password, or other security information. All orders must be accepted by us. We may choose not to accept orders at our sole discretion, even after we send you a confirmation email with your order number and details of the items you have ordered. For example, UZ Marketing reserves the right not to print adult content (art is accepted), copyrighted material, discriminatory material, FDA material, or money. You shall not use the UZ Marketing Service to violate any applicable laws or to infringe upon any third party's rights. All order delivery times are estimates, as it can vary based on the service/order. UZ Marketing will not be liable for any missed deadlines or delays, for any reason, and will not refund customers for this reason. UZ Marketing is not responsible for any late orders that may impact your project timeline and/or printing.

Accounts & Orders

Name and Address Changes

For any change of email, phone number and/ or postal address on your UZ Marketing’s account, you will be responsible for updating or advising UZ Marketing if there’s any change necessary. You may log in to your account via https://uzmarketing.com/user_login.php to update your account information. Our team is also available to assist you over the phone, also by contacting our customer service via email address or our online chat’s operating hours.

Order Cancellation

Any orders that haven’t entered production can be canceled and/or refunded. If you decide to cancel the order, please contact our sales department and they will walk you through the cancellation process. For any refunds, please allow up to 10 business days for the refund to be credited back to your account. An order that has entered production cannot be canceled, and no refund will be issued once it has entered production or any other process afterwards. Refunds for graphic design services or logos cannot be refunded.

Once an order has been placed and our team hasn’t received any design files or the files are incomplete, UZ Marketing may cancel your order and refund payment through the original payment method.


Shipping and Risk of Loss

UZ Marketing makes the best effort to communicate the delivery times with our customers depending on the product. Once an order is shown as delivered to the corresponding location through our carrier, UZ Marketing is not liable for the loss/damage of a product that was delivered through the shipping carrier. Any shipping damage or loss can be reported to our facility, however, we do not guarantee replacement of product. 

 

Completion & Delivery Dates

Any delay in the completion of a project due to external forces beyond our control (such as unusual transportation delays, unforeseen problems at a vendor site, computer/Internet related issues, holidays, bad road conditions, Acts of God, etc.), or actions and negligence of the client (i.e., content delivery delays), shall entitle UZ Marketing to extend the completion/delivery date, upon notifying the client, by the time equivalent of such a delay without penalty.

Below are some examples of things UZ Marketing cannot be held liable for in regards to shipping and delivery:

  • An order that is refused at time of delivery or undeliverable orders. (We will reship the product at the customer's expense if requested).
  • The product is lost, delayed or returned to UZ Marketing due to an error made by the customer in submitting the proper shipping address. (For product that is later found or that is returned to us we will reship the package with a corrected address and charge an additional shipping fee for the shipment).
  • Product that is delayed in shipping as a result of the customer providing inaccurate information.
  • Product that is delayed in production and/or shipping as a result of shipping company delays, acts of God, weather conditions, environmental or dangerous goods incidents, perils of the air, public enemies, public authorities acting with actual or apparent authority, acts or omissions of customs officials, authority of law, quarantine, riots, strikes, work stoppages or slowdowns, or other labor disputes or disturbances, civil commotions or hazards incident to a state of war, local or national disruptions in ground or air transportation networks or systems due to events beyond our control, disruption or failure of communication and information systems, disruption or failure of utilities, international customs issues, and any other circumstances that are beyond our direct control.
  • Return shipping is not covered.
  • The release of an order by the shipper without obtaining a signature.


Images Submitted

UZ Marketing permits users to upload their own designs and images onto their product of choice. UZ Marketing is not responsible for the quality of the images that you, as the user, uploads. You agree that once your images of choice are uploaded, that you are responsible for making sure that the quality of the images you are uploading have a high resolution and are satisfactory to the selected size or the product that you are purchasing through UZ Marketing's website. Images can be created in a variety of ways and you agree that UZ Marketing is not responsible for the quality of images for any type of file format. 

All images should be submitted at a minimum of 300 DPI at 1:1 ratio (or 100%) and/or in CMYK mode to avoid fuzzy, pixilated or otherwise distorted images. UZ Marketing is not responsible for images outside of these specifications.

 

Changes to Your Order

UZ Marketing provides users many opportunities to revise, review and cancel the order process before placing an order. Customers are also allowed to make last minute changes to order before it enters production. Once it enters production, orders cannot be canceled, refunded, or modified. 

You agree that UZ Marketing is not responsible for canceling, reviewing or revising images and order specifications once order has been placed. UZ Marketing's processing team or managers may revise or cancel the order, however, this is not an obligation, nor is it required.

When the order is placed, you agree that no further changes, modifications or corrections need to be made and that your order submitted is considered final as is and that you are satisfied with the product selection.

 

Job Abandonment 

Completed Orders

UZ Marketing allows users to pick up their orders up to 30 days from order completion. Orders that haven't been picked up 30 days after completion may be disposed of or recycled into UZ Marketing's Green Program. Orders that have been disposed of or recycled are not subject to be reprinted, refunded, or replaced.

Awaiting Customer's Action

Orders awaiting a customer's action with a failed attempt to respond in a timely manner of 30 days after the customer has been updated, will result in cancellation of the product. UZ Marketing is in no obligation to refund the order. Funds will be given to customers in the form of a coupon. Please note that designs do not qualify for a refund for work done. 

 

Approvals

The client will be ultimately responsible for the final approval of all comps, including the checking of typos and misspellings. It is important to make all final corrections before the project either goes live or is sent to the printer to avoid delays and additional fees. UZ Marketing will not be held liable for any work that has received final approval.

Errors that are contained in the uploaded customer file, e.g., misspelling, graphics, bleeds, grammar, damaged fonts, punctuation, wrong cuts, incorrect or missing folds, die lines, crop marks, transparency, overprint, and finished product size will not qualify for a reprint or a refund. UZ Marketing does not make any changes on print-ready customer files.
Written & Oral Authorization

Invoices will include (and the client shall be obligated to pay) fees or expenses that were authorized either by email, writing or over the phone.
 

12 Foot Viewing Distance Policy

To maintain transparency in communicating our quality control measures, we've established a guideline concerning blemishes or marks that are not easily distinguishable when viewed from a 12-foot distance or beyond. This guideline specifically applies to products like yard signs, magnetic signs, banners, and other print materials designed for long-range visibility. By adopting this approach, UZ Marketing can expedite production and offer competitive pricing below the industry standard.

It's important to bear in mind that these items are created to be effective when seen from a distance, as opposed to being closely examined by customers or viewers. Consequently, any minor flaws falling within this category – those that aren't easily noticeable from a distance of 12 ft or more – are not classified as defects. This policy allows for a reasonable tolerance of imperfections while still aligning with the practical usage of the products.

 

Stock Colors & Ink

UZ Marketing is not liable for color matching or ink density on screen proofs approved by you. Screen proofs will predict design layout, text accuracy, image proportion, and placement, but not color or density. UZ Marketing will use commercially reasonable efforts to match the gradient density of each color, but UZ Marketing is not liable for the final appearance of a color.

We offer basic stock colors for no additional fee. Stock color refers to those inks which we keep in inventory (or stock) all the time. These colors are subject to changes in tone and color due to differences in manufacturer chemical composition. 

In order to assure a color match, we offer additional colors, specified by Pantone PMS codes, for an additional fee. 

UZ Marketing may use gang-run printing to fulfill its orders. Gang-run printing is the process by which multiple (and different) customer jobs are combined on a large print sheet and are run at the same time. For example, we lay out 65 different customer business cards and postcards on one gang-run sheet, and run the sheet 1000 times to get 65 sets of 1000 cards. Each card set is a different card. This process allows us to spread the expensive initial setup cost of running a full-color offset print run among 65 customers. This causes a 1/16" tolerance area between the cut line and the safe line. For this reason, we recommend not adding borders to your business card or postcard designs, as this may cause the borders to appear uneven. 

In the printing process, all files must be converted to CMYK format for printing. Files submitted in RGB format may experience a color shift when printing due to this transition. We recommend all files be double checked to be submitted in CMYK format. UZ Marketing is not liable for any product that has experienced a color shift during the conversion to CMYK format, for example as a result of having been submitted by the customer in RGB or PMS Pantone colors.

We cannot guarantee the facility in which your order will be printed. In the case of a mechanical issue in one of our facilities, we may print your order in another facility to ensure you receive your order in a timely manner.

 

Additional Uses

If the client wishes to make additional uses of the work, the client shall seek permission from UZ Marketing and pay an additional fee to be agreed upon.



Promotions 


Discount Codes, Special Offers and Promotions

All discounts, special offers and promotions are created in the form of a coupon code. Each coupon code offered by UZ Marketing will have different requirements and reward amounts. Coupon codes provided are limited and a one-time use only. Any special offers, promotions or coupon codes may not be combined with another promotion, and if the coupon code does not function at check out when placing an order, it signifies that the order requirements are incorrect or the offer has expired. 

If your order has been canceled or rejected, or if you return all items that were in your order, then the coupon code provided will no longer be valid. Coupon codes are not redeemable for cash and will not be replaced if not used before expiring date or have been deleted under any circumstance by UZ Marketing.

If only part of your order has been canceled or rejected and only some of the items from the order have been returned, the coupon code will be applied to the product(s) that were kept. If an order was partially returned, canceled or rejected for any reason and the balance is less than the promotion or special offer, then the coupon code will only be applied to the outstanding balance. Any remaining amount of the special offer is void and the coupon code can no longer be valid or used.

UZ Marketing reserves the right to eliminate or discontinue any promotion or special offers at any time and immediately.    

Price Match

  • If you find a cheaper price from any of our competitors and you are interested in price matching, we require our customers to fill out this form https://uzmarketing.com/competitive-pricing-program-well-beat-everyone/ and submit the required information.
  • The quote must include a screenshot providing proof of the out the door pricing, meaning shipping and sales tax (if applicable) will be required. All order specifications must match to properly be compared and quoted. The screenshot needs to be dated with the present pricing from the competitor’s website.
  • Any price match must be requested and approved through an email confirmation before an order is placed through your UZ Marketing’s account. 
  • Special offers, coupons, or other promotions will not be applied to the price match price.

UZ Marketing reviews and responds to the price matching requests within 1-3 business days. We do not guarantee a price match for every order. If a competitor’s price is lower than ours, and price cannot be matched, UZ Marketing will always provide the best pricing offer to satisfy your customer needs.
